This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No.17 of 2020 registered at Chikhali Police Station, Pimpri-Chinchwad for the ofence punishable under Section 302 of the Indian Penal Code (IPC).

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

The applicant and the deceased were friends. It is alleged that the deceased had illicit relations with the wife of present applicant. According to the prosecution, on the day of incident, which took place on 8 January 2020 on account of alleged illicit relations, altercation took place between the deceased and the present applicant, while they were consuming liquor with their Dinesh S. 23-ba-153-22.doc friends at Hotel Jay-Malhar and in the said altercation the present applicant assaulted the deceased by paver-block. 5.

Prima facie, the incident does not appear to be premeditated. The applicant is in jail for more than two years. Considering the facts and circumstances of the case, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] Bail Application is allowed.

B] The applicant be released on bail in C.R. No.17 of 2020 registered at Chikhali Police Station, Pimpri-Chinchwad for the ofence punishable under Section 302 of the IPC on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
