The petitioners are aggrieved by the order passed by the Sessions Court in Criminal Appeal preferred by respondent nos.1 and Digitally signed by RAJESHRI PRAKASH AHER Date:
2022.07.08 16:12:32 +0530 RAJESHRI PRAKASH AHER 2 vide order dated 26th December, 2019 to the extent of 50% maintenance awarded by the learned Magistrate. There is a cross Appeal preferred by the petitioners before the same Court for enhancement of the maintenance.
The Appeal is pending since 2019. The petitioners are aggrieved by the order of stay granted by the appellate Court.
rpa 2/2 8wp214of2020.doc Considering the fact that Appeal is pending before the Sessions Court without adjudicating on merits of the matter or the order granting interim stay, directions can be given to the Sessions Court to expedite the Appeals preferred by both the sides.
Hence, I pass the following order:
:: O R D E R ::
(i) Writ Petition is disposed of;
(ii) Criminal Appeal No.241 of 2019 along with applications, if any, pending before the 15th Additional Sessions Judge, Dindoshi as well as Criminal Appeal No.244 of 2019, preferred by the respondents are directed to be decided expeditiously on or before 15th September, 2022.
