Heard learned counsel for the Applicant and the learned APP for the Respondent - State.

By this Application, the Applicant seeks his enlargement on bail in connection with C.R.No.342 of 2015 registered with the Khadki Police Station, Pune, for the alleged offences punishable under Sections 302, 307, 120B, 143, 147, 148, 149, 504 & 506 of the Indian Penal Code. 3.

Perused the papers.

The incident appears to be an outcome of a murder. The Complainant is one Nitesh Rajesh Lakhan and the deceased

BA 52-17.doc Sanjay Dedunda are alleged to have committed murder of two members of Bidlan family. It appears that the Complainant and the deceased were acquitted from the said offences. Pursuant thereto, the aforesaid incident has taken place on 26.12.2015. In the said incident, all the accused including the Applicant is stated to have assaulted the deceased with beer bottles and sticks. There are three eye witnesses to the incident. All the three witnesses have identified the Applicant, being one of the assailants. The Post Mortem report shows that the deceased has sustained as many as 18 injuries (including two fractures on his skull). Learned counsel for the Applicant submitted that the Applicant was identified after almost two months i. e. 22.02.2016. Be that as it may, the fact remains that the Applicant has been identified by the witnesses. The spot panchanama corroborates the incident. The incident has taken place in a broad day light. It is informed that the Applicant is 19 years of age. Considering the same the trial of the Applicant is expedited.

Taking into consideration the serious allegations, the Application is rejected. The Application accordingly stands disposed of.
