This is an application for cancellation of bail by the prosecution for breach of condition (iii) of the order of bail passed by this Court on 18th June 2015.

Condition (iii) of the order of bail reads thus :- "(iii)The applicants shall deposit a sum of Rs.7,50,000/- each in the trial Court within a period of 60 days from their actual release and the said amount shall be subject to such orders as the trial Court may pass at the conclusion of the trial". 3.

Learned APP has also invited my attention to the statement made by Adv. Pradhan at the time of hearing the application that

25-15-2016-APPP=.doc the applicants are ready to abide by any conditions that may be imposed, including the condition of deposit of Rs.7,50,550/- in the trial Court, if enlarged on bail.

Thus, the condition precedent for enlargement of bail was deposit of Rs.7,50,000/- and odd which the accused who is present before the Court, admits has not been complied with till date. 5.

Upon being asked the accused states that the prosecution has cheated this Court. The accused is at liberty to take appropriate steps, if so advised.

However, since he has already committed the breach of an order, his bail is cancelled, bond is forfeited and surety is discharged. He be placed in judicial custody till the conclusion of the trial.

The application stands disposed of.
