After having heard counsel for the petitioners at length, counsel for the respondents who are applicants in Rasta Case No.SR/38/2017 on the file of Tahsildar Palus seeks withdrawal of the said application.

As such, Rasta Case No.SR/38/2017 (Shri. Shankar Ananda Pawar & Ors. Vs. Meera Ganpati Patil & Anr.) stands disposed of.

However, this will not preclude the respondents from taking recourse to remedies as are permissible and available in law, which shall be decided without being influenced by withdrawal of the original application. BGP.

In case, if the issue of limitation crops up, the time consumed in prosecuting proceedings under Section 5 of the Mamlatdar's Court Act till this Court be taken into account.

As a sequel of above, the impugned order no more survives.
