After this petition was heard for some time, learned Counsel for the petitioners seeks leave to withdraw this petition with liberty to the petitioners to approach the CIDCO requesting for allotment of alternate plot of land, in view of the communication dated 3 August 2011 addressed by the CIDCO to the Batubai Zopadpatti Rahiwashi, Opposite Aayakar Colony, Sector 21, 22, Belapur, Navi Mumbai.

Allowed to be withdrawn with liberty as prayed for. All contentions of the parties are expressly kept open.

We also keep open remedy of the petitioners to file suit in the event it is so felt appropriate.
