The applicant is seeking bail in CR No.I-25 of 2015 dated 4.2.2015 registered with Kopri Police Station, Thane under Sections 395, 143, 147, 149 of the Indian Penal Code and Sections 4 and 5 of Mumbai Gambling Act. The learned Counsel for the applicant submitted that the other coaccused who are similarly situated have been released on bail by this Court by its orders dated 23.7.2015, 28.9.2015 and 8.1.2016. He therefore claimed parity with the said co-accused persons. The learned APP fairly conceded to the said submission.

In view of the above, the applicant is entitled to be released on bail on the ground of parity.

2/2 ba.56-2016 Hence, the following order:

(i) The applicant shall be released on bail on his furnishing PR bond of Rs.50,000/- with one or two solvent local sureties in the like amount. (ii) The applicant shall attend the concerned Police Station on the first and third Saturday of every month between 10.00 a.m. to 11.00 a.m. for a period of six months from the date of his release and thereafter on the first Saturday of every month between 10.00 a.m. to 11.00 a.m.till the conclusion of trial. (iii) The applicant shall not tamper or attempt to influence or contact the witnesses or any person concerned with the case. (iv) The applicant shall inform his latest place of residence and mobile contact number immediately after being released and/or change of residence or mobile details, if any, from time to time to the Court seized of the matter and to the Investigating Officer of the concerned Police Station. (v) If there is a breach of any of the aforesaid conditions, the prosecution shall be at liberty to seek cancellation of the applicant's bail. The Application is allowed in the aforesaid terms. (A.S.
