By this First Appeal, the Appellant original Plaintiff is challenging the Judgment and Decree dated 29th & 30th November 2018 passed by the Bombay City Civil Court at Mumbai in L.C. Suit No. 3169 of 2006 dismissing the Appellant's suit restraining Respondent original Defendant No.1 from carrying out unauthorised construction.

Considering the submission made by the learned Counsel for the Appellant and the impugned Judgment and Decree, I am satisfied that Appellant has made out a case for the following order:

a) Admit.

b) Printing is dispensed with.

c) Appellant to file private paper Sneha Chavan 1/2

d) Registry is directed to call R & P immediately.
