Applicant is seeking bail in connection with C.R.No.1162 of 2019, registered with Pandharpur City Police Station, Solapur Rural, for the ofences punishable under Sections 143, 147, 148, 149, 326, 324, 323, 504 and 506 of Indian Penal Code ("IPC", for short) and Section 135 of Maharashtra Police Act. First Information Report ("FIR", for short) was lodged on 16th July, 2019.
The prosecution case is as follows:
Injury certifcate of Rajesh Nemade, who had allegedly assaulted by sickles mentions that he had sufered CLW
rpa 2/3 902-ba-119-2020.doc on left side region and blunt trauma by hard and blunt object. Nature of both the injuries was simple.
Learned counsel for the applicant submitted that after receipt of the injury certifcate, which refers to the nature of injuries sustained by the injured Rajesh, instead of reducing the charge from Section 326 of IPC, the charge was converted into 307 of IPC.
Learned APP submitted that role was attributed to the applicant-accused. Investigation is in progress. Considering the fact that the applicant is in custody from the date of arrest, all the other accused are granted bail and in the light of the injury certifcate, further detention is not called for and case for grant of bail is made out.
Hence, I pass the following order:
:: O R D E R ::
(i) Bail Application No.119 of 2020, is allowed;
rpa 3/3 902-ba-119-2020.doc (ii) Applicant is directed to be released on bail in connection with C.R.No.1162 of 2019, registered with Pandharpur City Police Station, Solapur Rural, he be released on bail on his executing P.R. Bond in the sum of Rs.25,000/-, with one or more sureties in the like amount; (iii) Applicant shall attend the concerned Police Station once in a month on frst Saturday of the month between 11:00 a.m. to 01:00 p.m., till further order;
(iv) Bail Application stands disposed of.
