Heard learned Counsel for the parties.

Though the respondent no.7 is duly served, no one appeared on behalf of them, when the matter called out.

This Application is preferred by the Insurance Co. for condonation of 147 days delay in filing First Appeal challenging the award dated 02.05.2011 passed by the M.A.C.T. Palghar in M.A.C.P. No. 112 of 2010.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

i) Civil Application is allowed in terms of prayer clause (a) which read thus :

"a) The delay of 147 days in filing the appeal may kindly be condoned."

ii) Civil application stands disposed off accordingly.
