This is an application for condonation of delay in preferring the appeal challenging the conviction of the applicant/accused for offences punishable under Sections 376(1) and 342 of the Indian Penal Code as well as under Sections 4 and 6 of the Protection of Children from Sexual Offences Act. avk 1/2

2-APPA-30-2019.doc Heard the learned counsel appearing for the applicant/accused and the learned APP. Perused the application. The applicant/accused is undergoing the jail sentence imposed on him by the learned trial court. It appears that as the applicant/accused is undergoing the jail sentence, there was nobody to look after the further steps to be taken in the matter by filing the appeal.

In this view of the matter, the following order :

ORDER

i) The delay in filing the appeal is condoned.

ii) The application is disposed off accordingly.
