Civil dispute between the petitioner owner and respondent No.3 Developer is already going on. Grievance in the present matter is about alleged unauthorized construction made by respondent No.3. Submission is the petitioner has made representation to respondent No.2 Municipal Council in the matter and the Municipal Council is not taking decision on that representation.

As Civil dispute is pending we are not inclined to intervene in extraordinary jurisdiction. Grievance can be looked into by the said Court. 3.
