This is an application seeking suspension of execution of the sentence of one year passed by the learned Additional Sessions Judge, Nashik for the offence punishable under Section 332 of the Indian Penal Code inter alia imposing a fine of Rs.2,000/-.

Mr. Solkar, learned Counsel for the applicant submits that the amount of fine has already been deposited in the trial Court and on the same day, on an application moved before the said Court, the applicant was enlarged on bail pending the appeal in this Court.

Looking to the short sentence awarded by the trial Court and the fact that the applicant was already released on bail during trial, no fruitful purpose would be served in rejecting the prayer, for which even the learned APP has no serious objection.

Considering the aforesaid facts, pending the appeal, the applicant be enlarged on executing a PR bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Additional Sessions Judge, Nashik 5.
The applicant shall not leave the jurisdiction of the Sessions Court, Nashik without seeking prior permission. 6.
The applicant shall attend Bhadrakali Police Station once in three months on every 1st day of the English Calendar month between 9.00 a.m. to 10.00 a.m. until further orders. 7.
Application stands disposed of.
