The petition is filed seeking direction to respondent to carry re-investigation into FIR No.236 of 2012. Mrs. Deshmukh, learned APP, on instructions, makes a statement that after investigation into the said FIR, the investigating officer has filed "A"summary report and the same was also accepted by the Metropolitan Magistrate, 31st Court at Vikhroli, Mumbai. Accordingly, she has placed on record the report dated 8th April, 2015 of the Senior Police Inspector, Vikhroli Police Station, Mumbai.

In the light of the above, we are not inclined to entertain the petition in exercise of extraordinary jurisdiction conferred upon this Court under Article 226 of the Constitution of India, especially when the petitioner is at liberty to challenge the acceptance of the "A" summary report by the learned magistrate.
