However, the Notice in Civil Application No.1751/2015 could not be served upon him on the ground that he does not reside in the said village. Said ground is not acceptable as on the same address, he was served in original proceedings. Hence Civil Application No.264 of 2016 is allowed in terms of prayer clause (b).

Civil Application is disposed of.
