This Appeal is filed by the Complainant challenging the order passed by the learned Metropolitan Magistrate Mumbai, dated 30 September 2000 acquitting the Respondents-Accused of the offence punishable under section 138 of the Negotiable Instruments Act, 1881.

None appears for the Appellant. None appeared when the Appeal was called out for hearing on 2 June 2017 and again on 16 June 2017. Matter appeared on board notified from 28 to 30 June 2017. This board was notified in advance. It was also notified as a provisional board earlier. The Appeal was kept back twice and then was adjourned till today. None appeared on behalf of the Appellant throughout whenever the Appeal is called out for hearing.

The cheques in question were stated to be issued in the year 1995 i.e. 22 years ago. The acquittal is of the year 2000. Appeal is not being prosecuted by the original Complainant. Accordingly it is dismissed for non-prosecution.
