Inasmuch the Petitioner has an alternate remedy before the DRT, we are not inclined to entertain the Petition. The Petition is dismissed with liberty to the Petitioner to approach the DRT. We are not inclined to stay the e-auction is scheduled to be held on 21 January 2021. We however record the statement of learned Counsel for the Respondent-Bank that for a period of one week from today, the Respondent Bank shall not issue the sale certificate in the event the auction fructifies.
