Mr.Bhavake, learned counsel for the petitioner states that during the pendency of this writ petition, the Education Officer, who has earlier rejected the proposal of the Management to grant individual approval to the appointment of the petitioner on the post of Laboratory Assistant on the respondent no.7 school on 11th July, 2018 has recalled his own order and has granted the approval by an order dated 10th August, 2021. He seeks liberty to withdraw this petition and seeks further reliefs in furtherance of the said order dated 10th August, 2021.

Learned AGP on the other hand strongly urged that the 1/2

7-wp6691-19.doc said order dated 10th August, 2021 is illegal. In view of this rival contention, we make it clear that this Court has not gone into the validity of the order dated 10th August, 2021. As and when the petitioner files a fresh petition, this Court will decide this issue. 3.

The writ petition is dismissed as withdrawn with liberty as prayed for.
