Heard Mr. Thorat, learned counsel appearing for the Petitioner and Mr. Gaurav Parkar, learned counsel appearing for the Respondent.

Respondent - Anish Narayan Bhonsule is present in Court. After taking instructions from him, Mr. Gaurav Parkar, learned counsel appearing for the Respondent states that he has instructions to withdraw the application bearing Exh.24 filed in R.A.E. Suit No.221 of 2018. Mr. Thorat, learned counsel appearing for the Petitioner has no objection for such withdrawal. Therefore, leave to withdraw the said application bearing Exh.24 filed in R.A.E. Suit No.221 of 2018 is granted.

As said application bearing Exh.24 filed in R.A.E. Suit No.221 1/2

904-wp-482-2023.doc of 2018 is withdrawn, order dated 18th August 2022 passed by the learned Judge, Small Causes Court at Mumbai below Exh.24 in R.A.E. Suit No.221 of 2018 does not survive and therefore, the same is quashed and set aside.

Writ Petition No.482 of 2023 is disposed of in above terms with no order as to costs.
