By this application the applicants apprehending their arrests in connection with investigation of Crime No.I-451 of 2020 of Police Station Mumbai Naka, Nashik for offences under section 120-B, 199, 200, 406, 417, 420, 468 and 471 read with 34 of Indian Penal varsha
7.aba.98.2021 with IA 203 of 2021.doc Code are seeking Anticipatory Bail. The record discloses that the interim protection was granted to the applicants on 25th January 2021 and is operating since then.

The learned counsel for the applicant, on the last date had submitted that the final summary report is filed by the investigating officer on the last date i.e. 4th January 2022, time was granted to the learned APP to enable him to take instructions. 3.
The learned APP on instructions, states that the final summary is filed. In such circumstances, nothing survives in the application.

It is made clear that this Court has not expressed any opinion on the merits of the final summary. The learned Magistrate shall decide the acceptability of the final summary on its own merits after hearing the parties. In the event, the final summary is not accepted, liberty to the applicants to renew the request for anticipatory bail.

The Anticipatory Bail Application is disposed of in the aforesaid terms.
