This Revision Application was called out for hearing on 15th March, 2021, when none appeared for the Applicant and therefore, it was kept back and called out today for hearing. Today also, none appeared for the Applicant.

With the assistance of the learned APP, I perused the record. Record indicates that, the Applicant (Original Accused No.2) along with other two co-accused, was convicted for commission of offence punishable under Section 120-B read with Section 408 of the Indian Penal Code and was sentence to suffer simple imprisonment till rising of the Court and to pay fine of Rs.5,000/- on each count, by the learned Additional Chief Metropolitan Magistrate, 19th Court, Esplanade, Mumbai by its Judgment 1/2

Criminal Appeal No.213 of 2001, preferred by the Applicant has been dismissed by the learned Additional Sessions Judge, Greater Mumbai by its Judgment and Order dated 15th March, 2003. Record indicates that, this Court admitted the aforesaid Revision Application on 29th November, 2004 however, no interim relief was granted to the Applicant.

It appears from the record that, as the Applicant has already undergone the sentence imposed upon him by the Trial Court, he is no more interested in pursuing the present Revision Application. It may be the reason, the Applicant is not appearing before this Court consistently. In view thereof, Revision Application is disposed off. (A.S. GADKARI, J.) by Sanjiv S.
