In Crime No.141/2018 for offence punishable under 367, 143, 147 148, 148, 149, 504 and 506 of the Indian Penal Code registered on June 27, 2018 with Alandi police station, District Pune, the applicant is seeking pre-arrest bail on the ground of false implication at the instance of one of the friend of the complainant and filing of the charge-sheet against the co-accused.

Learned APP has produced the papers of investigation and opposed the claim for bail.

Having perused the investigation papers, prima facie, it cannot be inferred that the offence punishable under section 367 of the Indian Penal Code is not made out in absence of any grievous hurt. That being so, the applicant, in my opinion, deserves to be released. Hence the order :- i) In the event of arrest in Crime No.141/2018 for offence punishable under 367, 143, 147 148, 148, 149, 504 and 506 of the Indian Penal Code registered with Alandi police station, District Pune, the applicant be released on bail on his executing P.R. bond of Rs.25,000/- with one in the like amount;

ii) The applicant shall attend the Investigating Officer as and when directed;

iii) The applicant shall not influence the prosecution witnesses or tamper with the evidence;

iv) The application is disposed of accordingly.
