In crime No.689/2018 for offfence punishable under section 306 read with 34 of the Indian Penal Code registered with Sinhaghad Road police station, Pune, the applicant, a Zilla Parishad member, is seeking pre-arrest bail.

The prosecution case is, deceased Ashok, died on September 26, 2018 was working as a Headmaster, was assaulted by the applicant along with co-accused, as in discharge of his duties as Headmaster, he had punished some students. 4.
Learned APP opposed the bail on the ground that the complainant has named the applicant with a specific role. 5.
Having considered the submissions and having perused the case diary, in post mortem report no external injuries on the body of deceased Ashok are noticed. Apart from above, the applicant, a public servant, is very much available for investigation. There are no criminal antecedents. Hence the order :- i) In the event of arrest in Crime No.689/2018 for offfence punishable under section 306 read with 34 of the Indian Penal Code registered with Sinhaghad Road police station, Pune the applicant be released on bail on his executing P.R. bond of Rs.25,000/- with one surety in the like amount; ii) The applicant shall attend the Investigating Officer on Tuesday and Friday between 10.00 a.m. to 12.00 noon for

iii) The applicant shall not influence the prosecution witnesses or tamper with the evidence;
iv) The application is disposed of accordingly.
