This is an application for bail in CR No.I-381 of 2020 registered with Vashi Police Station for offence u/s 376(2)(n), 420 and 506(2) of IPC.

The FIR indicate that the applicant and complainant were acquainted with each other since 1999. There was love affair. Subsequently complainant got married in 2011. Even applicant performed marriage. In 2015 as alleged, the applicant had contacted the complainant and tried to allegedly blackmail her. In February2017 she was called by applicant at Vashi Station. They went to place Sagar Vihar. The applicant kept on messaging the complainant. Again she was called in February, March 2017. There was physical relationship.

The applicant was arrested on 26th November 2020. Apparently relationship appears to be of consensual nature. Further detention of applicant is not warranted. Hence, I pass following order :

ORDER

(i) Bail Application is allowed and disposed of;

(ii) The applicant be released on bail in connection with CR No.I381 of 2020 registered with Vashi Police Station, on his executing PR bond in the sum of Rs.20,000/- with one or more sureties in the like amount;

(iii) The applicant shall attend concerned Police Station once in three months on first Saturday between 11 am and 1 pm till further orders;

(iv) The applicant shall not contact or message the complainant; (v) The applicant is permitted to furnish cash security in the sum of Rs.20,000/- for a period of eight weeks in lieu of surety. 4.
