The applicant is apprehending arrest in C. R. No. 913 of 2019 registered with Sakinaka Police Station for the offence under Sections 353, 504, 506, 341 of the Indian Penal Code.

The FIR was registered on 14.11.2019. The complainant is BEST bus driver. It is alleged that while reversing the BEST bus it was noticed that auto rikshaw was behind the bus and the driver of auto rikshaw was requested to stop at the location to avoid collusion. The applicant was passenger in the auto rikshaw. She abused the complainant. She threatened and assaulted him.

It is submitted that the applicant is a lady aged about 51 years. She has no criminal antecedents. On the same day the FIR is registered at the instance of the applicant vide C. R. No. 914 of 2019 with the same police station for the offence punishable under Sections 504, 506 of the IPC.

The FIR was registered on 14.11.2019. The applicant is a lady. The incident occurred about 1 1⁄2 years ago and apparently investigation had proceeded. The applicant need not be subjected to custodial interrogation. Hence, the order:

ORDER

(i) The application is allowed.

(ii) In the event of arrest of applicant in C.R. No. 913of 2019 registered with Sakinaka Police Station, the applicant be released on bail on executing P.R. bond of Rs.25,000/- with one or two sureties in the like amount.

(iii) The applicant shall attend the Investigating Officer twice a week on Wednesday and Friday between 11.00 a.m. to 1.00 p.m. till filing of charge-sheet.

(iv) The application stands disposed of.
