This application is preferred by plaintiff for condonation of 36 days delay in filing Appeal from Order challenging the order dated 08.10.2014 passed by Bombay City Civil Court, Mumbai below Exh.1 in Summary Suit No. 3204 of 2011.

10 caa 384-15=.doc learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.
Hence, the following order:
i) Civil Application is allowed in terms of prayer clause (a) which read thus:
"a) The delay of 36 days in filing the present Appeal from Order be condoned and the captioned Appeal from Order be adjudicated on merits."
ii) Rule made absolute accordingly. No order as to costs.
