DATED : 25 JANUARY 2023 P.C. :- This is an application under Section 439 of the Code of Criminal Procedure, 1973 for bail.

The applicant came to be arrested in Crime No. 152 of 2022 registered at Ozar Police Station for the offences punishable under Sections 420, 406, 463, 464, 467, 468, 471, 120-B read with 34 of the Indian Penal Code.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

According to the complainant, the present applicant and other coaccused had prepared a forged will dated 27 November 2019 of her husband, who died on 28 November 2019. The present applicant is the MJ Jadhav 1 / 2

928-BA-93-23.odt brother of the husband of the complainant.

The learned counsel for the applicant submits that the applicant is not the beneficiary of alleged forged will. It is submitted that applicant is in jail for more than two months.

Prima facie, the dispute appears to be of a civil nature. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail. Hence, the following order is passed: (i) Application is allowed.

(ii) The applicant- Virendra Shivaji Bhadke shall be released on bail in Crime No. 152 of 2022 registered at Ozar Police Station for the offences punishable under Sections 420, 406, 463, 464, 467, 468, 471, 120-B read with 34 of the Indian Penal Code on furnishing PR bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.
