Heard. By Writ Petition No.362/2017 the petitioner - plaintiff challenges the order dated 31.12.2016 passed by the learned District Judge -IV and Additional Sessions Judge, Kalyan below Exhibit- 56 in Civil Appeal No.40/2015 rejecting the petitioner's application for compromise. 2.

In Writ Petition No.375/2017 the order under challenge is dated 31.12.2016 passed by the learned District Judge -IV and Additional Sessions Judge, Kalyan below Exhibit-57 in Civil Appeal No.43/2015 rejecting the petitioner's application for compromise.

During the course of arguments, the learned counsel for both the petitioners submits that the civil appeal Nos.40/2015 and 43/2015 stood disposed of finally by common order dated 31.12.2016.

In view of subsequent development that both the appeal stood disposed of, nothing survives in the present Writ Petitions.

Both the petitions stand disposed of as infructuous.

6.

All contentions of both the parties are kept open for settling the matter.
