Heard. This Application is made by claimants for condonation of 34 days delay in preferring the appeal challenging the award dated 27/12/2012 passed by the 3rd Jt. Civil Judge, Senior Division Nasik in LAR No.226/2003.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Civil Application is allowed in terms of Basavraj G Patil 1/2

44.2221.14-caf prayer clause (a) which reads thus:

"(a) That the delay of 34 days in filing the said First Appeal against the judgment and award in LR No.226/2003 passed by the Jt.

Civil Judge, Senior Division Nashik dated 27/12/2012 may kindly be condoned in the interest of justice."

b) Civil Application stands disposed off accordingly.
