After arguing the matter for sometime, Mr. Aashay Topiwala, learned Counsel for the Applicant seeks withdrawal of the Bail Application as the Court is not inclined to grant bail. However he submits that in the facts and circumstances of this case, the trial be expedited as the Applicant is in the custody since 28th March 2023. 2.

Accordingly, the Bail Application is allowed to be withdrawn and disposed of as such.

However, the learned Trial Court is requested to expedite the trial and to conclude the same within a period of 1 and 1⁄2 years, as the victim is 9 years old.
