Learned APP submits that the charge is framed and examination-in-chief of P.W. 1 is completed. The learned APP submits that it would not be appropriate to consider an application under section 439 of the Code of Criminal Procedure, 1973 in the midst of the trial.

On this, the learned Counsel for the applicant upon instructions seeks liberty to withdraw the application. Liberty as prayed for is Talwalkar 1/2

However, learned Special Judge seized with the MCOC Special Case No. 3 of 2016 is requested to expedite the trial by ensuring that the accused are produced before the Court on each and every date. Upon failure, the learned Special Court shall take appropriate action.

The application stands dismissed as withdrawn and disposed of accordingly.
