Learned counsel appearing for the respondent nos. 3 states that the petitioner had challenged the draft annexure which is on page 66 of the petition and that the petitioner had not challenged the final annexure which is on page 67. He submits that both the authorities have in fact granted liberty to the petitioner to challenge the final annexure. However, petitioner instead of availing his remedy to file an appeal, has filed this petition. 2.

Learned AGP states that if such an appeal is filed before the Page no. 1 of 2

In view of the aforesaid statement, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file an appropriate appeal before the respondent no.2. 4.

In view of the aforesaid, petitioner is allowed to withdraw the petition with liberty as prayed. Appeal to be filed within two weeks from today. If the appeal is filed, same to be considered by the respondent no.2, uninfluenced by the earlier order passed. 5.

It is clarified that I have not examined the petition on merits and hence all contentions of all parties are kept open. 6.
