After arguing for some time when this court declined to entertain the Appeal from Order, the learned counsel for the appellant after taking instruction from his client who is present in court makes a statement that he may be permitted to withdraw the Appeal from Mohite 1/2

12 ao11-17withca.doc Order. He further submits that hearing of Special Civil Suit No.2371 of 2015 pending before City Civil Court be expedited as the same is between father and son. To that effect, he has given in writing. Same is taken on record and marked "X" for its identification. Same is accepted.

Hence, following order is passed:

a Appeal from Order stands disposed of as withdrawn.

b Hearing of Special Civil Suit No.2371 of 2015 pending before City Civil Court at Mumbai is expedited.

c This court expects Trial Court to decide Special Civil Suit No. 2371 of 2015 as early as possible but in any case on or before 31.12.2019.

d Parties to act on authenticated copy of this order.
