This application is directed against the order dated 10th March, 2003 whereby 4th Additional District and Sessions Judge, Pune, dismissed the Criminal Revision Application No.28 of 2003 and rejected the prayer of the Applicants to set aside and quash the order dated 24th December, 2002, passed by the Judicial Magistrate, First Class (A.C. Court), Pune issuing process against the Applicants of the offence punishable under section 138 of the Negotiable Instruments Act.

Rule was granted by this Court way back in the year 2003 and ad-interim relief was granted, whereby the proceedings in Criminal Case No.3262 of 2001 pending before Judicial Magistrate, First Class, Pune, were stayed.

It is seen that when the matter was called out on last two hearings the Applicants were not present. It appears to me that the Applicants are not interested in continuing the proceedings. Since the Proceedings are of the year 2003 and the criminal case is pending since 2001, no purpose will be served in keeping the application pending. 4.

Hence, the application is dismissed for want of prosecution. (ANUJA PRABHUDESSAI, J.) 2/3
