This is a common order on the above two petitions between the same parties. The petitioner is the accused in the two proceedings filed under Section 138 Negotiable Instruments Act by respondent no.1 for the offence punishable under Section 138. The

This being the defence of the petitioner will have to be raised and considered at the appropriate time during the course of the trial. Hence, the petitions are dismissed.
