The learned Advocate for the Respondent states that the Respondent has no objection if the Petition for restitution of conjugal rights i.e. Hindu Marriage Petition No.513 of 2016 filed by the Respondent before the Court of Civil Judge, Sr. Division at Thane, is transferred to the Family Court at Nashik. In view thereof, the following order is passed :

(i) the record and proceedings of the Marriage Petition bearing H.M.P. No.513 of 2016 filed by the Respondent herein in the Court of Civil Judge, Sr. Division at Thane, is transferred to the Family Court at Nashik. (ii)The Applicant wife shall be allowed to file her Written Statement as well as evidence before the Family Court at Nashik and only thereafter the Court shall proceed with the trial.
