Mr. Kadam, learned counsel appearing on behalf of applicant, having taken instructions from his client makes statement that the applicant does not press for the relief claimed in prayer clause (b) of the application. Statement is accepted.

Learned counsel for applicant, however, submits that time to deposit an amount of Rs.40,00,000/- as per order dated 22nd December, 2016, in Criminal Appeal No.813 of 2016, be extended by four weeks from 1/2

In the light of above, we dismiss the application as prayer clause (b) is not pressed. However, as on today, the applicant has not deposited any of the amount as per directions issued by this Court, by order dated 22nd December, 2016, in Criminal Appeal No.813 of 2016. 4.
In the light of above statement and by way of indulgence, we grant two weeks time from today, to deposit first instalment of Rs.20,00,000/- and the balance amount of Rs.20,00,000/- to be deposited within two weeks thereafter.

In the event, applicant fails to deposit any of the amounts within time stipulated above, order dated 22nd December, 2016 shall stand vacated.
