Mr. Surel Shah, learned Counsel appearing for the Petitioner seeks leave to withdraw this Writ Petition with liberty to file an Appeal before the Grievance Redressal Committee under Section 35A of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971. An Appeal shall be filed within one week from today and a copy thereof shall be served upon Respondent's Advocate simultaneously. If any, application for condonation of delay or for exclusion of time is filed, the Appellate Authority shall consider the fact that Writ Petition was pending before this Court challenging the impugned order which is sought to be challenged in the said appeal proposed to be filed under Section 35 A of the Act and that this petition was prosecuted in good faith and with due diligence.
