The learned Counsel for the applicant, after lengthy argument, seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. The application stands disposed of as withdrawn. 2.

The learned counsel for the applicant submits that the applicant would appear before the concerned Magistrate on or before 24.1.2018. The learned Magistrate shall consider the application on its merits without being influenced by the withdrawal of the present application. In view of this, the applicant stands protected till 5 p.m. on 24.1.2018. In the eventuality the applicant does not surrender before the Magistrate on or before 24.1.2018, the police would be at liberty to arrest the applicant.
