This is an application for anticipatory bail in CR No.308 of 2018 registered with Tardeo Police Station. The first information report was lodged on 14th December 2018. It is alleged that the applicant is residing in the same vicinity and building where the complainant resides and it is alleged that the applicant had kissed the victim child on her cheek two months prior to lodging of FIR and on the date of complaint the applicant was trying to call the victim girl by whistling.

It appears that after registration of the FIR the applicant had attempted suicide and was hospitalized. The first incident had occurred two months prior to registration of FIR and the second incident had occurred on 14th December 2018 when applicant
2 of 2 916.ABA.76.2019.doc alleged to have whistled and called the victim girl. Learned Sessions Judge while rejecting the application had observed that there is possibility of pressurizing or threatening the victim and her mother as the accused and victim and her mother are residing in the same building.

The apprehension expressed by the investigating machinery can be taken care of by imposing certain conditions. Hence, I pass following order :
ORDER
(i) In the event of arrest of applicant in connection with CR No.308 of 2018 registered with Tardeo Police Station, the applicant be released on bail on furnishing PR bond in the sum of Rs.25,000/- with one or more sureties;
(ii) The applicant shall not tamper with the evidence and shall not pressurize or threaten the victim and her mother; (iii) The applicant shall not reside in the vicinity where the complainant is residing;
(iv) The applicant shall report the investigating officer on 23rd, 24th and 25th January 2019 between 11am and 1 pm;
(v) Criminal Anticipatory Bail Application No.76 of 2019 stands disposed off.
