By this interim application, the applicant seeks impleadment of Public Works Department, Nashik as respondent no.4. There is a dispute in respect of the certificate issued by PWD which was relied upon by the applicant. In our view, impleadment of Public Works Department, Nashik as respondent no.4 would be thus necessary.

The interim application is made absolute in terms of prayer clause (a). The amendment shall be carried out within one week from 1/2
6-ia1364-22.doc today. The amended copy of the writ petition shall be served upon the newly added party within one week thereafter. The Public Works Department, Nashik shall file affidavit in reply within two weeks from the date of communication of this order along with the amended copy of the writ petition.

The interim application is disposed off in aforesaid therms. There shall be no order as to costs.

The applicant to communicate this order to the respondent no.4 as well as other respondents.

Office is directed to issue notice upon the respondent no.1 in view of the learned advocate on record having been elevated to the Bench of this Court, returnable on 26th September, 2022 with a request to remain present in person or through new advocate. It shall be made clear in the notice that no further adjournment would be granted.
