1] This is an appeal fled by the State of Maharashtra against the judgment and order dated 22.04.2002 passed by the learned Chief Judicial Magistrate, Nashik in Regular Criminal Case No. 107 of 1995, whereby the sole respondent has been acquitted for the ofence punishable under Section 409 read with 34 of Indian Penal Code.

2] Learned APP has placed on record the report of Assistant Police Inspector of Jaikheda Police Station dated 3.12.2020 and submits that the notice could not be served upon the sole respondent, the statement of the wife of respondent was recorded and she has disclosed that her husband Yeshwant Dinesh Sherla 1/2

5-appeal 825-02.doc Laxman More (respondent) has expired on 24.1.2015. In view of this, Criminal Appeal No. 825 of 2002 against the sole respondent Yashwant Laxman More stands abated. 3] Accordingly, Criminal Appeal No. 825 of 2002 stands disposed of.
