The order dated 8-12-2015 passed by the Competent Authority by which the cross-examination by the Petitioner i.e. original Respondent No.2 of the Estate Officer MHADA is closed, is taken exception to by way of the above Petition.

The Learned Counsel for the Respondent No.3 states that the Respondent No.1 to the Case No.26 of 2013 i.e. the Respondent No.3 herein who is the main contesting party in the said proceeding has no objection to the Estate Officer being cross-examined by the Respondent No.2 i.e. the Petitioner herein.

In view of the said statement made by the Learned Counsel for the Respondent No.3, the impugned order dated 8-12-2015 would stand set aside. mmj

wp-783-16-(902) The Petitioner would be entitled to cross-examine the Estate Officer, the same to be done on 17-5-2016 and the cross-examination as far possible to be completed on the same day. This is as and by way of final indulgence and no further opportunity would be granted.
