Learned APP Ms Malhotra true to her role as an officer of this court, states that the entire allegation was against respondent no.1 and there is nothing against respondent no.2. Ms Malhotra states that respondent no.1 died as recorded in the order dated 1-3-2018 and the death certificate is also on record. Ms Malhotra states that there is nothing against respondent no.2 and even the dying declaration is totally silent. Ms Malhotra states that the court can dispose the appeal without going into the merits of the matter.

Appeal accordingly dismissed.
