Both the counsel submit that in the present proceedings, they are challenging the order passed by Trial Court in respect of section 9A of the Code of Civil Procedure, 1908. Both the counsel submit that in view of subsequent Mohite 1/2

s25 cra36-16with40-16.doc development for amendment of section 9A nothing survives in both the Civil Revision Applications.

At this stage, advocate for added defendant in Regular Civil Suit No. 3499 of 2012 submit that hearing of suit be expedited. Considering the submissions made by both the counsel, and impugned order, following order is passed:

a) Both the Civil Revision Applications stand disposed of as infructuous in view of subsequent development that section 9A of Code of Civil Procedure, 1908 is deleted.

b) Hearing of Regular Civil Suit No. 3499 of 2012 is expedited. c) No order as to costs.
