The Applicants, who are respectively the husband and the brother-in-law of the first informant, apprehending their arrest in connection with the investigation of Crime No. 519 of 2021 registered with Vairag Police Station, Dist. Solapur under Section 498-A, 323, 504 and 506 read with Section 34 of I.P.C., are seeking pre-arrest bail.

The aforesaid offence is registered on the basis of the complaint lodged by Mrs. Devai Amol Pachpute, who is the wife of the Applicant No.1 alleging that she was mentally and physically ill-treated.

I have heard the learned counsel for the parties. Perused record.

On 25.01.2022 interim protection was granted to the Applicants, inter alia on condition of attendance. The learned counsel for the Applicants submits that the Applicants have accordingly reported to the Investigating Officer and have cooperated with the investigating agency. 5.

Having regard to the nature of the allegations and the fact that the Applicants have reported to the Investigating Officer, I find that the custodial interrogation of the Applicants is not necessary.

In the result, the Criminal application is disposed of in terms of order dated 25.01.2022, subject to the condition that the Applicants shall report to the Investigating Officer and co-operate with the investigating agency as and when required and shall not tamper with the prosecution evidence/witnesses.
