Mr. Desai, the learned Counsel for the Petitioner submits that the instant petition has become infructuous as in terms of the impugned order dated 19th September, 2016, a preliminary issue regarding the jurisdiction of the Trial Court was framed and said issue also came to be decided in favour of the Petitioner.
