The learned counsel for the Appellant / Applicant has tendered a praecipe in the Court. Paragraph 6 of the said praecipe reads as under:

"6. The Appellant / Applicant therefore humbly prays that keeping in view the legal submissions made by Respondent No. 4 who is now the Liquidator of Respondent No. 10, that this Hon'ble Court kindly grants this Appellant the permission to withdraw the present Criminal Appeal No. 29 (L) of 2019 and the Delay Condonation Application No. 46 of 2018 with the 1 / 2

16 - APEALST. 29-18 liberty to take steps as may be available to the Appellant association and its depositor members under law."

Accordingly, the appeal is allowed to be withdrawn with liberty, as prayed for and is accordingly disposed of.

In view of disposal of the criminal appeal, pending criminal application for condonation of the delay does not survive and is accordingly disposed of.
