The order impugned is passed by the Appellate Court rejecting prayer for stay as the petitioner/appellant has failed to demonstrate any illegality by citing a single reason or ground to that effect. The decree under challenge is for partition and separate possession which is under execution.

In that view of the matter, no interference is called for in the impugned order.

The petition as such stands dismissed.

However, considering the fact that the appeal is pending since 2012, hearing of the same is expedited. It is directed that the appeal be decided within a period of six months. [NITIN W. SAMBRE, J.] BGP.
