Learned APP submits that the police intimated the petitioner-complainant that the issues raised in the complaint filed by the petitioner are of civil nature and therefore, complaint could not be registered as FIR. Learned APP tendered communication dated 25/4/2016 along with report dated 11/4/2016, which is taken on record.

We observe that petitioner may resort to alternate remedy as prescribed under the Cr. P. C. All issues on merits are kept open.

Petition is disposed of accordingly.
